Do I Waive My Rights?

If you choose to mediate, you do not waive your right to an attorney or your right to a trial. Mediation is non binding, meaning if you are not satisfied with the negotiation process, you do not have to agree to anything. If you do find the outcome of mediation satisfactory, it is customary to sign a settlement agreement. The settlement agreement is then binding, just like any other contract you might sign.

Mediation

Mediation is an informal, non adversarial method of resolving disputes. Mediation ensures both parties a level playing field on which to decide issues and create agreements with equality and dignity. Mediation emphasizes fairness, flexibility, good communication and honest problem solving skills. Mediation sessions are conducted by an impartial third party (mediator), who facilitates the resolution of issues and maintains a safe and constructive atmosphere at all times. Mediators do not decide a case, award damages, counsel, or give legal advice. Mediators help the parties to communicate their differences, identify their options and chose workable, sustainable solutions. Mediation occurs in a comfortable, neutral, informal and confidential setting.

collaboration in parenting, understanding

parenting plans and reaching agreements about parenting issues to be included I a parenting plan, and complying with the court’s order regarding their parental rights and responsibilities and parenting time. The process of Parenting Coordination is also a mediation process
